These Terms & Conditions ("Terms") govern your use of the Thailand Care website at thailandcare.com and the related referral service (together, the "Service") operated by Thailand Care ("we", "us", "our"). By using the Service, submitting an enquiry, or otherwise interacting with us, you agree to be bound by these Terms.

If you do not agree, please do not use the Service.

1. About the Service

Thailand Care is an independent patient-referral service. We publish information about medical procedures available in Thailand and connect prospective patients with independent partner clinics, hospitals, and surgeons (each a "Provider") that we believe may be suitable for the patient's enquiry.

We are not a medical provider, healthcare professional, healthcare facility, telemedicine service, insurer, or travel agent. We do not diagnose, advise, treat, prescribe, perform procedures, or operate hospitals. All medical decisions, treatment plans, and outcomes are the sole responsibility of the patient and the treating Provider.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract in your jurisdiction. The Service is offered globally. You are responsible for ensuring your use of the Service complies with the laws of your country of residence.

3. Our Role — and Its Limits

When you submit an enquiry, we may:

  • Provide general information about procedures, recovery, indicative pricing, and the patient journey
  • Match you with one or more Providers based on your enquiry
  • Pass your contact details and enquiry information to those Providers so they can contact you directly with quotes, consultations, and bookings
  • Help re-establish communication with the Provider if you need to contact them later

We do not, at any time and under any circumstances:

  • Provide medical advice, diagnosis, prescription, or treatment
  • Recommend or endorse any specific Provider, procedure, or course of treatment
  • Verify, audit, license, accredit, certify, supervise, or quality-assure any Provider. We take reasonable care in selecting Providers we work with, but we do not independently confirm every claim, qualification, accreditation, licence, outcome statistic, before-and-after image, testimonial, or representation made by or about a Provider
  • Act as the agent, employee, partner, joint venturer, or representative of any Provider
  • Take any responsibility for the conduct, services, treatment, outcomes, complications, billing, or aftercare of any Provider

The contractual and treatment relationship for any medical care is directly between you and the Provider. Providers are independent third parties.

4. Enquiries and Information You Provide

By submitting an enquiry, you agree to:

  • Provide accurate, current, and complete information
  • Disclose relevant medical history, medications, allergies, and contraindications to the treating Provider (not to us — we do not assess medical suitability)
  • Make your own informed decisions about any treatment, after consultation with the Provider and, where appropriate, an independent medical professional in your country of residence
  • Comply with all pre-operative and post-operative instructions issued by the treating Provider

Information you submit is handled in line with our Privacy Policy.

5. Payment Flow — You Pay Providers Directly

You pay Providers directly. We never accept, hold, process, refund, escrow, or otherwise handle payment for any medical procedure, hospital stay, surgical fee, anaesthetist, hospital pharmacy, accommodation, airport transfer, recovery hotel, or any other Provider service. All financial transactions for those services are concluded directly between you and the relevant Provider under the Provider's own commercial terms.

We are not a party to your contract with any Provider and have no obligation — financial, performance-based, or otherwise — under that contract. Disputes about price, refund, performance, scheduling, complication, or outcome of treatment are between you and the Provider, not us.

Prices, packages, and estimates shown on this website are indicative only, were obtained from Providers at the time of publishing, and are not offers. The Provider's quote after consultation is the definitive price.

We do not charge patients a fee for the referral service. We may receive a referral fee, commission, or other consideration from Providers in connection with bookings; this is paid directly between us and the Provider and never increases the price you pay.

6. Travel, Accommodation, and Logistics

We do not provide and are not responsible for any travel-related service, including but not limited to:

  • Air travel, ground transport, or transfers
  • Visas, passports, or immigration matters
  • Hotels, recovery accommodation, or short-term rentals
  • Travel or medical insurance
  • Currency exchange, baggage handling, customs, or excursions

Any travel or accommodation services discussed on this website are arranged by independent third parties, including the Provider in some cases, and are governed by those third parties' own terms. You travel and stay at your own risk, including the risks associated with international travel before or after surgery (such as deep-vein thrombosis), differences in healthcare standards between countries, language barriers, and continuity of care after returning home. You are solely responsible for ensuring you have suitable travel and medical insurance covering medical tourism, complications, and repatriation if needed.

7. Assumption of Risk

You acknowledge and agree that:

  • Medical treatment, particularly elective surgery undertaken away from your home country, carries inherent and material risks — including infection, bleeding, scarring, anaesthetic reactions, dissatisfaction with outcome, the need for revision treatment, permanent injury, and in rare cases serious complications including death
  • These risks exist regardless of the skill or care of the Provider
  • You are responsible for evaluating, with appropriately qualified medical professionals, whether a procedure and travelling for it are suitable for you
  • You voluntarily assume all risks associated with the procedure, the journey to and from Thailand, your stay in Thailand, your recovery, and any complications that may arise during or after treatment
  • You undertake all of the above at your own risk and expense

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Submit false, misleading, or impersonated information
  • Scrape, crawl, harvest, or otherwise extract content from the website except as standard search-engine indexing
  • Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
  • Attempt to bypass any access controls or security measures
  • Use the Service to send spam, unsolicited communications, or to promote competing services
  • Reverse-engineer or attempt to extract source code, except where permitted by mandatory local law

We may suspend or terminate your access at any time if we reasonably believe you are misusing the Service.

9. Intellectual Property

The website and its content — including text, images, graphics, logos, branding, design, code, and the selection and arrangement of all of the foregoing — are owned by Thailand Care or its licensors and are protected by copyright, trade mark, and other intellectual-property laws. You may not reproduce, modify, distribute, publicly display, or create derivative works from any part of the website without our prior written consent, except for personal, non-commercial reference use.

Trade names, marks, and logos of Providers shown on this website remain the property of their respective owners.

10. Disclaimer of Warranties

The Service and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, timeliness, security, and that the Service will be uninterrupted, error-free, or virus-free.

We make no representation or warranty about any Provider — including the Provider's qualifications, licensure, accreditation, equipment, hygiene, language ability, outcomes, complication rates, pricing, scheduling, follow-up, or insurance coverage. The mere fact that a Provider appears on this website or is suggested in response to an enquiry is not, and may not be relied upon as, a recommendation, endorsement, certification, or warranty of any kind.

You agree to conduct your own due diligence on any Provider before consenting to treatment, including verifying credentials, accreditation, and patient outcomes; obtaining a second medical opinion; and reviewing all consent forms and surgical agreements offered by the Provider directly.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, revenue, savings, data, goodwill, opportunity, or other intangible losses
  • We will not be liable for the acts, omissions, negligence, misconduct, or insolvency of any Provider, travel provider, accommodation provider, insurer, or other third party, including any medical injury, complication, dissatisfaction with treatment, mis-diagnosis, infection, scarring, additional cost, or death
  • Our total aggregate liability for any and all claims arising out of or relating to the Service is limited to the amount you have actually paid directly to us for our coordination services in the twelve (12) months preceding the claim. Because we do not currently charge patients a fee, this amount is currently US$0, subject to any minimum amount that applicable mandatory law may require
  • We will only be liable for damages caused by our intent or gross negligence; in all other cases our liability is excluded to the maximum extent permitted by law

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by our own negligence, or for fraud or fraudulent misrepresentation by us).

12. Indemnification

You agree to indemnify, defend, and hold harmless Thailand Care, its directors, officers, employees, contractors, and partners from and against any claim, demand, loss, liability, damage, fine, penalty, or expense (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your enquiry, consultation, treatment, recovery, or relationship with any Provider or other third party; (c) your travel, accommodation, or any other matter described in Section 6; (d) your breach of these Terms; or (e) your violation of any law or the rights of any third party.

13. Force Majeure

We are not liable for any failure, delay, or interruption in performance caused by events beyond our reasonable control, including without limitation acts of God, natural disasters, pandemics, epidemics, public-health emergencies, war, armed conflict, terrorism, civil unrest, government or regulatory action, border closures, transport strikes or disruptions, supply-chain failures, internet or hosting outages, and Provider closures or insolvencies.

14. Limitation on Actions

Any claim or cause of action arising out of or relating to the Service or these Terms must be filed within twelve (12) months of the date on which the cause of action arose, or it is permanently barred — except where applicable mandatory law requires a longer period.

15. Third-Party Services

Our website may contain links to third-party websites, services, and content (including Provider websites). We do not endorse and are not responsible for the content, products, services, privacy practices, or availability of any third party. Your use of any third-party service is at your own risk and subject to that third party's terms.

16. Privacy

Our processing of personal information is described in our Privacy Policy, which forms part of these Terms. Information you provide is also shared with the Provider(s) you are matched with, after which the Provider's own privacy practices apply.

17. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service (in whole or in part) at any time without notice. We may also update these Terms from time to time. Material changes will be reflected on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of {{JURISDICTION}}, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in {{JURISDICTION}}, except where mandatory local consumer-protection law gives you the right to bring proceedings in your country of residence.

19. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced by an enforceable provision that comes closest to expressing the original intent.

20. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.
